EU Legal Additions for International Fourthwall Shop

These legal additions are intended to complement Fourthwall’s standard Terms of Service, Privacy Policy, and Returns & FAQ, and apply only where mandatory consumer protection laws require it, particularly for customers located in the European Union (EU) and Austria.

2. Scope & Priority of EU Consumer Rights

If you are a consumer residing in the European Union, mandatory consumer protection laws of your country of residence apply and shall take precedence over any conflicting provisions in the general Terms of Service.

All other customers remain subject to the general Terms of Service as published.

3. Right of Withdrawal (EU Consumers Only)

Withdrawal Policy

If you are a consumer residing in the European Union, you have the right to withdraw from a purchase contract within 14 days without giving any reason.

The withdrawal period will expire 14 days from the day on which you, or a third party indicated by you, acquires physical possession of the goods.

Effects of Withdrawal

Refunds, cancellations, and withdrawal processing are handled by Fourthwall, Inc. as Merchant of Record.

EU consumers retain their statutory right of withdrawal in accordance with applicable law.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods that are made to the consumer’s specifications or clearly personalized;

  • Goods produced on demand (print-on-demand products), unless defective;

  • Digital content once delivery has begun with the consumer’s express consent.

4. Returns & Defective Products (EU)

Your statutory warranty rights under EU law remain unaffected.

If a product is defective, damaged, or incorrectly produced, you are entitled to a replacement or refund in accordance with applicable EU consumer law.

Nothing in these Terms shall deprive consumers residing in the European Union of mandatory consumer protection rights granted by the laws of their country of residence.

For non-EU consumers, the governing law and jurisdiction clauses stated in the general Terms of Service remain applicable.

7. Merchant of Record

Orders, payments, fulfillment, and customer service related to merchandise are handled by Fourthwall, Inc., acting as Merchant of Record.

These EU legal additions apply solely to the creator-operated aspects of the store.

8. Language & International Use

These legal additions are provided in English for international accessibility. In the event of interpretation differences, mandatory local consumer protection laws shall prevail.
